Albany -- An Albany man shot in a scuffle with a store clerk, will be arrested.

Thirty-year-old Jahwar Harris was shot in the abdomen while struggling with the co-owner of High Dollar Fashions on Broadway Court yesterday.

Police now say they will charge Harris with robbery by intimidation.

Surveillance video showed Harris putting a pistol on the counter while dickering with Damien Gardner over the price of the shirt.

Gardner picked up the gun and stuck it in his pocket. When Harris tried to get it back, he was shot.

He remains hospitalized under police guard and will be arrested when he's released.
