Indictment insight given

Newton, Georgia-- Prosecutors believe a jury needs to help answer the dozens of questions surrounding a fatal police shooting in Newton.

Last week, a grand jury indicted Captain David Zigan and patrolman James Freeman on involuntary manslaughter charges for shooting Herschel Bullard on October third.

"Which is why it was proposed to them in the way it was. I don't think I have the right to decide this case. It was an issue that they needed to determine," says district attorney, Joe Mulholland.

Mulholland says Bullard fired a gun to chase away a man who threatened to rape his wife. Police responded to his home after those gunshots.

Officers Zigan and Freeman claim Bullard shot at them and they returned fire. Zigan remains on medical leave recovering from a gunshot wound. Freeman has resigned.
