Court sends back school suit

Thomasville, Georgia-- An NAACP lawsuit against Thomasville city schools is headed back to a lower court.

An appeals court judge ruled a federal judge did not apply a correct legal standard to part of the case.

The NAACP sued Thomasville Schools in 1998, claiming the school system segregates students by classes, discipline, and instructional ability. Last year, a federal judge threw out the suit claiming it had not basis.
