Albany- A Dougherty County family is suing the school board because they say a teacher attacked their son.
Radium Springs Middle School teacher Mike Lewis is charged with simple battery. He's accused of grabbing a student around the neck and pushing his head against a wall last October.
The family says the boy suffered emotional distress and had to have counseling.
"They'll try to prove that he needs to be paid X amount of dollars because he had these amount of injuries," said School Board Attorney Tommy Coleman.
The school system contends the child was not hurt. The school board did not renew Lewis' contract for this school year.
