Woman claims judge assaulted her

Americus- Judge Rucker Smith is charged with misdemeanor battery and is out of jail on a recognizance bond.The 52 year old returned to work Tuesday and even held a full calendar of police and revocation hearings.

According to Sunday's incident report, Rachel Oliver told Americus police her boyfriend, Rucker Smith, has assaulted her at her Highway 27 East home. Oliver claims he was upset that she hadn't come home the night before and knocked her down several times, threw her off the porch and choked her.

The report also notes that Smith denied hitting Oliver but admitted things got out of hand. The incident is still under investigation by the Sumter County Sheriff's Office.

District Attorney Cecilia Cooper says because the charge is not a felony, the governor and bar association would not get involved. Sumter County State Court Solicitor General Howard McKelvey has recused himself from the case and will ask the attorney general to appoint a special prosecutor to try the case.
