Albany- The City and Dougherty County are being sued for forcing a trash company to dump in the county landfill.

Hauling Refuse began taking trash from Dougherty County to a landfill in Taylor County owned by its parent company. Dougherty County passed an ordinance saying Hauling has to keep the garbage in the county.

"The issue simply is, is the ordinance and resolution that the county has put in effect to protect the citizens of this community, constitutional or a violation of the interstate commerce clause," said county attorney Spencer Lee.

County leaders say if Hauling takes local garbage out of the county, the county landfill will lose money.
