Albany-- The Governor is appointing a panel to decide if indicted Albany Commissioner Henry Mathis will stay in office while awaiting trial.

The three person panel, made up of two public officials and the attorney general will have two weeks to decide if Mathis has to vacate his city commission seat until the outcome of his trial on extortion charges.

Mathis has pleaded not guilty to charges that he extorted money from a man who worked at an Albany nightclub that the commission had granted an alcohol license.
