Candidate files suit over wrong ballot

Ashburn- A candidate who lost a November election is suing because some voters were give ballots from a 2003 election.

Charles Gibbs ran for Ashburn City Council, but his name wasn't on old ballots mistakenly given to 44 voters.

35 of them returned on election day to vote on good ballots. Ashburn City Attorney Tommy Coleman says election workers contacted the Secretary of State's Office and acted quickly to correct the problem.

"We don't believe there's enough votes in error, after the correction, to make any difference in the outcome of the election," Coleman said.

Charles Gibbs lost by about 80 votes.
