Supreme Ct. upholds CON regulations for medical centers

Albany- Albany Surgical wanted to open an ambulatory surgery center.

It applied for a Certificate of Need from the Department of Community Health and was denied. Albany Surgical sued, claiming the Certificate of Need regulations are unconstitutional.

The Georgia Supreme Court disagreed and upheld the state's right to regulate construction of hospitals and medical facilities.
