Albany -- 32 year old Albany Police Officer James Thomas is now formally charged with stealing the wallet from a man badly hurt in a motorcycle crash.

Thomas is accused of taking the wallet of 27 year old James Burgess, as Burgess lay bleeding on the street. Burgess was unconscious after his motorcycle was hit by a car on Dawson Road April 5th.

The next day his family reported his wallet missing. This is officer James Thomas at the scene of that wreck. Our video shows a black object in his hand, which investigators say is the missing wallet.

Witnesses told investigators they later saw Officer Thomas rifling through the wallet at the emergency room. We are told that Burgess had more than three thousand dollars in his wallet.

James Thomas, is a two year veteran of the Albany Police Department. He's been suspended with pay since April 9th, and now that he's indicted, his status with the department will change.

The assistant chief won't say whether he'll be suspended without pay or fired.
