Mistrial declared in rape case

January 9, 2004

Albany-- The rape trial of an Albany business owner has ended in a mistrial, after the jury could not reach a verdict.

Twenty-six-year-old Matthew Hardwick was charged with raping a young female friend. Investigators say he was giving her a ride to his business, the Elevations Beauty, Barber, and Fitness Salon on East Broad, when he attacked her.

The jury announced they could not reach a verdict last night after two hours of deliberations, and the case was declared a mistrial.

No word if the District Attorney will re-try Hardwick.
