Albany-- Richard Jerome Benning is charged with setting fire to his apartment at 703 West Whitney Avenue Tuesday.

Investigators say he and his family were being evicted, and he set fire to some bedding material.

"There had been an attempt earlier in the day to start a fire at this same location," said Albany Fire Chief James Carswell. "So once we started to do interviews and take statements it actually the whole case revolved around one individual. And that's who we have in custody now."

Investigators say Benning set fire to the apartment twice, but the first attempt failed.
