Jurors may decide Commission/Sheriff lawsuit

Albany - Dougherty County commissioners want a jury, not a judge, to decide the outcome of the lawsuit the Sheriff brought against them. Monday, the county filed a petition for a jury trial.

County Attorney Spencer Lee says this is a case about facts not laws, so citizens not a judge should hear the case. Superior Court Judge Ronnie Lane will decide if a jury trial is necessary.

The trial, originally set for August 13th, is now tentatively rescheduled for September 30th. The Sheriff claims the county commission illegally eliminated the criminal investigation and patrol units, and the crime scene technician, which save the county $300,000.
