ALBANY, GA (WALB) – A month after Albany business owner Walter Phelps was shot during an armed robbery at his store, the 67-year-old former Lee County commissioner has died.

Phelps died in the Emergency Room at Phoebe Putney Hospital around one o'clock Saturday afternoon.

He was shot in the back as he opened P&P garden store on Saturday July 3rd.
Just three hours after he was shot, surveillance video captured two men using Phelps' credit card to buy thousands of dollars worth of clothes.

APD charged 17-year-old Ryan Richardson and 22-year-old Roderick Ferrell with armed robbery and aggravated assault.

Richardson worked for Phelps in June at P&P Garden and Hardware Center.

It is unclear if Phelps' death is related to his gunshot wound, the charges at this time remain the same, his body will be sent to Macon on Monday for an autopsy.
