ALBANY, GA (WALB) –  A grand jury will decide whether to indict the Dawson City manager on a theft charge. Barney Parnacott is charged with theft by receiving for purchasing a piece of heavy equipment from a man who apparently didn't own it.    

Ernest Jones claims he owned the bulldozer and left it on Thomas Jones' property to be repaired. Thomas Jones is charged with theft by taking for selling it. 

"What I do believe is that in this situation, he has the documentation, the dozer belong to him and that's all that's important to me, aside from the rest of it, I didn't want to take warrants Mr. Jones or want to take warrant on Mr. Parnacott, it's just this is the investigation, right's right, wrong, wrong the dozer belongs to Jones," said Inv. Alicia Parker of the Terrell Co. Sheriff's Office.    

During a hearing Wednesday Judge Jim Thurman said he's not sure there was any intent to deceive, but he bound the case over to the grand jury.    

Investigators testified the equipment was left on Thomas Jones' property for more than seven years, but he never formally tried to foreclose or take legal possession of it.
