ALBANY, GA (WALB) –   An Albany accountant has asked the 11th Circuit U.S. Court of Appeals to re-examine a ruling that he cannot sue former Dougherty County District Attorney Ken Hodges.

Charles Rehberg filed suit against Hodges, after Rehberg was charged with burglary and assault in the Phoebe Factoid case.

Rehberg and Dr. John Bagnato sent out anonymous faxes pointing out excessive spending at Phoebe Putney Hospital. All criminal charges were dropped against Rehberg.

Rehberg's appeal says the panel ruling violates his Fourth Amendment rights as a whistleblower, and says Hodges' should not have immunity because he fabricated and manipulating evidence.

Hodges is a candidate for state attorney general.
