ALBANY, GA (WALB) – A federal appeals panel ruled late Thursday that the former Dougherty District Attorney cannot be sued by a man who says he was wrongly prosecuted for his criticism of Phoebe Putney Hospital.

Charles Rehberg claimed then D.A. Ken Hodges abused his power by tracing Phoebe Factoid faxes back to Rehberg then passing that information to Phoebe executives. Rehberg was arrested, but the charges were later dropped. Hodges, who is now running for Attorney General, claimed he should have immunity because he was just doing his job.

Rehberg's suit against Hodges' former chief investigator can continue.
