ALBANY, GA (WALB) –An Albany Doctor is indicted for sexually assaulting a patient.

The Dougherty Grand Jury indicted Dr. Kalpesh Patel of the Albany Neurology and Headache Center.

Prosecutors say on March 6th, 2008 Patel placed his hands on a patient's breasts and pulled down her underwear with his ink pen.

Patel is expected to turn himself in Thursday night or Friday and post $10,000 bond.

The D-A says he will not stop the doctor from seeing patients.

Dougherty D.A. Greg Edwards said  "There is no prohibition against him continuing his medical practice as far as I am concerned. We'll go from that point."  The Doctor could face 30 years in prison if convicted.

The Grand Jury also indicted Byron Alday on 333 counts of forgery and felony theft by conversion.

The indictment says Alday, as an employee of Denson Enterprises, deposited $270,000 worth of company checks into his own account over the last two years.

Alday has nine previous convictions for forgery dating back to 1984.

He is being held in the Dougherty County jail on 50 thousand dollars bond.
