ALBANY, GA (WALB) -  The 11th circuit court of appeals agrees former District Attorney Ken Hodges should have immunity in a false imprisonment lawsuit filed against him.

Former Dougherty County assistant police chief Woody Hart filed the multi-million dollar lawsuit against Hodges in 2003. Hart claimed Hodges violated his plea agreement by ordering him to complete a state prison sentence after he was released from federal prison on bribery and perjury convictions.

Wednesday, the court ruled Hodges should be allowed immunity, except for the statements he made to the press. The court found the general council to the Department of Corrections and head warden also named in the suit should not get absolute immunity.
