ALBANY, GA (WALB) - Albany's city Attorney says a straw poll for citizens to vote on whether they want to vote on consolidation isn't likely to happen.

Nathan Davis cites an opinion by the Attorney General that says taxpayer dollars can't be used for holding straw polls or public opinion referendums. The reason is because there is no language in either the city charter or state law that specifically allows that authority.

"My initial review through the city of Albany's charter and through Georgia law is there is nothing in there authorizing non-binding referendums," said Nathan Davis, City Attorney.

On Tuesday an Albany voter asked city commissioners to consider holding a non-binding referendum to gather public opinion about consolidation.

Commissioners asked Davis to look into whether that's possible.
