ALBANY, GA (WALB) - Two Moultrie men charged in a fatal home invasion nearly three years ago will face a jury this week.

 A jury was selected Monday to hear arguments against Tyrus Carter. He's charged with felony murder and aggravated assault in a home invasion October 23, 2006.

Twenty-two-year old Diego Diaz-Gomez was shot and killed. Sixteen year old Santos Perez was also shot in the leg but survived.

Co-defendent Anthony Thompson, whose first trial ended in a hung jury, is scheduled for a retrial following Carter's case.
