ALBANY, GA (WALB) - An Albany firefighter, fired for using a truck and firefighters to clean up his family's property, has filed a discrimination claim against the city.  

Rod Jolivette filed an EEOC complaint contending he was passed over for promotion in November 2008 to a lesser qualified white man. Jolivette says he believes he was denied the promotion because he's black.

Jolivette's termination papers indicate he was fired last month because he misused department equipment, resources, and manpower to help a relative clean up a flooded house on Gail Avenue.
