ALBANY, GA (WALB) - Albany Federal Judge Louis Sands dismissed Palmyra Medical Center's anti-trust lawsuit against Phoebe Putney Hospital Tuesday.
Now, Phoebe leaders want Palmyra's owners to reimburse Phoebe a half million dollars for legal fees.
Palmyra filed the lawsuit last year charging that Phoebe acted as a monopoly by attempting to stop Palmyra from some managed care markets and insurance plans.
Today, Phoebe CEO Joel Wernick called for Palmyra to refund money spent fighting the suit.
"These people who file frivolous lawsuits should actually reimburse our patients for the additional cost that we had to incur," said Wernick. "And I would specifically call upon them to, in fact, come forward and reimburse us for all legal expenses incurred."
Palmyra released a statement that said: "We are reviewing the decision and considering our options. We believe our community deserves to have a true choice, and that will only come through fair competition."
