ATLANTA, GA (WALB) – The Georgia Supreme Court ruled Monday in the case of an Albany man convicted of killing his step-uncle nearly 4 years ago.

In 2008, a Dougherty county jury found 40-year-old Ricky Johnson guilty in the murder and armed robbery of 64-year-old George Ponder.

 Ponder was found dead inside his Shirley Avenue April 28, 2007.

Prosecutors said Johnson slit Ponder's throat then used his A-T-M card.

The high court upheld the murder conviction, but reversed the count of armed robbery due to circumstantial evidence.

Johnson is currently serving a life sentence.
