ALBANY, GA (WALB) - The United States Supreme Court Monday agreed to review an Albany case after a federal appeals court ruled Charles Rehberg cannot sue a Dougherty District Attorney investigator for lying to the grand jury.
Rehberg was indicted for burglary and assault after sending out the Phoebe Factoids, whistle blowing faxes that criticized Phoebe Putney hospital administrators and hospital financial practices.
All charges were later dropped.
The 11th Circuit said the D-A's office had immunity from Rehberg's lawsuit, even if they knew investigator Jim Paulk's testimony to the Grand Jury was false.
