ALBANY, GA (WALB) - The fighting continues among Randolph County School Board Members and now members have asked the court to allow them to unseat the chairman of the board.
The motion was filed on behalf of Don Smith, Dymple McDonald, and James Mock to unseat chairman Henry Cook. Cook would remain on the board, but a new chairman would preside. The members say even though a judge ordered Cook to allow the majority vote to prevail on issues, he and superintendent Bobby Jenkins continue to go their own way.
They claim other members are acting unlawfully. Their attorney says there's precedent to remove Cook as chairman, but Cooks attorney says it shouldn't be an issue before the court.
"The general law throughout the country and Georgia is that absent some sort of statutory term set by the General Assembly or a constitution is a board has the right to remove whoever they appoint, even if they set a term themselves," said Attorney Tommy Coleman.
"Our position is that we appealed the case and the case is on appeal and while the case is on appeal the trial court judge has lost jurisdiction on the case," said Attorney Maurice King.
Those board will hold a hearing Friday concerning the firing of Superintendent Bobby Jenkins. Jenkins attorney says he doesn't believe that hearing has any legal affect.
